Isle of Man

E-COMMERCE
AND THE LEGAL
INFRASTRUCTURE

The Isle of Man is an independent self governing jurisdiction and is responsible for its own legislation, which can be passed quickly. It has a modern and sophisticated legal infrastructure which provides an ideal environment in which to develop e-business enterprises. The legal system is based on English common law and the Island's legislation is generally derived from mature English legislation which is enhanced by facilitative bespoke legislation designed for the offshore environment. However the Isle of Man is not a member of the EU (essentially only the EU's free movement of goods provisions apply to the Island) and therefore most EU law has no direct effect in the Isle of Man.

Any e-business owner/entrepreneur who identifies one of the very small number of Offshore e-jurisdictions which have the technological capacity to host e-businesses will inevitably apply a legal checklist in assessing the strengths and weaknesses of such jurisdictions.

Questions and Answers regarding secure encrypted e-mail

Q: Are you helping criminals to communicate and evade the law?

A: NO Secure methods of communication are available to everybody and many law abiding citizens and businesses alike are moving to secure their communications channels.
Up until now, secure e-mail communication was usually either, expensive and proprietary, or difficult and time consuming to use.
SecExMail uses industry standard protocols and e-mail clients so that not only criminals and national security agencies can have secure communications but so can you, a seamless privacy for everybody.

Q: Why offshore, are you harboring criminals?

A: NO Offshoremailroom is located on the Isle of Man and will comply with all local law enforcement requirements. The Isle of Man Government or Tynwald as it is called, has very sensible laws and processes in place which ensure a series of checks and balances.
This means that anyone suspected of using Offshoremailroom for criminal activities will receive due process. If a court order is served, Offshoremailroom will comply. It also means that if you live in a country where the same right to due process is not granted to you, your communication is safe as the Manx Government grants you this right.

Q: If the government in my country asked you to spy on my e-mail account, would you do it?

A: NO If they called us directly...

Answer: YES ...if they presented a case to the local law enforcement (via Interpol or the like) and a local judge deemed there to be due cause, the local court would issue a court order. This court order would be complied with.
